Alaska State Supreme Court: Troopergate

On Friday, The Alaska State Supreme Court agreed to hear an  emergency appeal from lawyers seeking to shut down the Legislature's investigation of Gov. Sarah Palin. 

The state Supreme Court scheduled oral arguments on their appeal for 3 p.m. Wednesday and agreed to rule no later than the close of business Thursday.

On September 16, five Republican state lawmakers filed a lawsuit to stop the investigation that was authorized by the legislative council. The following day we posted a blog that stated, "this is ridiculous as no judiciary is going to insert itself in a disagreement between lawmakers over a difference of opinion."

In July, a bi-partisan group of lawmakers had voted unanimously to support an investigation into the governor's firing of former public safety commissioner Walt Monegan and that her office potentially abused their power.

Only after Governor Sarah Palin was named to the McCain ticket did a handful of Republican lawmakers begin complaining about fairness and attempting to delay the final report.

On Thursday, Superior Court Judge Peter Michalski dismissed the  lawsuit, ruling that the conduct of the investigation did not violate the right to fairness. He found the Legislature has the right to investigate, and issues such as whether that happens through a council or committee are not for the courts to decide and is "business to be left to the legislative branch."

As we stated after the lawsuits were filed, the lawmakers filing this suit have no standing to sue their fellow lawmakers. The legislature operates with the rule of 21 and 11 meaning 21 votes in the House and 11 in the Senate allows the legislature to set their own rules and direction by a majority vote. The ruling by Michalski proved the judiciary will not get involved in a legislative spat between lawmakers.

In addition, Michalski threw out a lawsuit filed by Alaska Attorney General Talis Colberg. Colberg, a Palin appointee, was attempting to persuade the court to quash the Legislature's subpoenas ordering state officials to testify in the investigation. By dismissing Colberg's suit, Judge Michalski ruled the subpoenas were legally issued and enforceable.

Look for the Alaska State Supreme Court to uphold Judge Michalksi's ruling and allow independent investigator Steve Branchflower to go about his business. 

This is nothing more than a frivolous lawsuit. The legislature is free to conduct their business as they see fit and the rules are worked out among themselves based on a majority of the votes in the Senate and House and the judiciary is not going to get involved between squabbling lawmakers.

The Supreme Court only agreed to take this case due to public interest and establishing a precedent so the next time the lawmakers want to sue themselves they won't burden the court.

What is the most absurd about this whole process of wasting time and money is the lawsuit was filed by some of the same Republican lawmakers like Fred Dyson who have long berated Alaskan judges for legislating from the bench.

The Supreme Court will toss this out and then Branchflower will put his report out.

JimAK may simply be someone who likes to yank the chains of others. He goes too far for him to really believe all the nonsense he spews. So I am doubting he is a relative or friend of Palin's. But he certainly could just be an idiot. Can't tell which one: amateur arguer or big dope. Hmmmmmmmm.

Jim...I can tell by your posts and the way that you just wait to pounce on Andrew that you are a very loyal friend, relative or employee of Palin. I admire that..I really do. I have to say though, I worry for how you are going to feel once all of the nastiness surrounding Palin finally settles in with you. You must admit that the original investigation was bipartisan...after all there were more repubs who voted for it than dems. There are those embarrassing phone calls that those nasty old troopers taped with Frank Bailey...there is the workmans comp company...whose owner now has to tell the truth or perjure herself...due to the honest person she has an employee...(she called a tip line) There are Palins countless lies these last weeks. Come on..you know what I am talking about. The woman is a nasty piece of work. She has a head full of ambition and not much else I am afraid. During these last weeks I have met some wonderful Alaskans. These people are not jealous of Palin...they dont wish her ill for the heck of it...they feel for her family, but they know she is not the right person to be VP of the United States. Some of these people even voted for her to be governor...however...not much chance they will do so again, after her allowing the McCain camp to go in and take over the Alaskan Dept of Law. Perhaps you are of the ilk of that man who writes for the distinguished National Review. You know...the one who said that when he watched Palin debate the other night...and she winked...he knew she was winking at him and he sat a little straighter on the sofa. He also said that when she smiled or spoke...she sent little starbursts through the screen. Please Jim...dont drink any more koolaid.


Branchflower's Subpoenas

What is the status of these subpoenas? Will they be enforced? Will these 13(?)people testify before Branchflower issues his report? What will happen if they still refuse to appear?

Don't forget the Texas Lawyers who are pushing for this lawsuit... I don't think they could find any Alaskan Lawyers who would take the frivolous case... Once the McCain Goon Squad goes home, the Carpetbagging McCain Lawyers are going with them...

They should be held accountable

Lorraine is absolutely on the right track. These legislators have no valid reason for filing this suit. It's no more than a thinly veiled McCain truth squad mission. Dyson and Coghill have a hard time drawing any seperation between the government, and their evangelical views of the world. Dyson is a homophobe that is still mad that same sex partners can get health insurance benefits. It would be so much better to have more uninsured people so the rest of us can absorb the costs right Fred? I too will be willing to donate to anyone running against these guys.

... Dyson's opponent looks far more interested in the Community that Dyson. Dyson is more interested in Holding up demented Values and trying to call them "Conservative" than he is in serving the people in Eagle River anyway....
