The Alaska Public Safety Employees Association filed an ethics complaint against the State of Alaska on Thursday concerning the release of confidential personnel information from the file of State Trooper Mike Wooten, Governor Sarah Palin's ex brother in law.

The complaint arises from a recorded phone called between Palin aide Frank Bailey and State Trooper Rodney Dial where Bailey is sharing confidential information from Wooten's personnel file while trying to make the case to get Dial's help in getting Wooten fired.

Currently the legislature is investigating the governor for potential abuse of power for allegedly firing Public Safety Commissioner Walt Monegan because he refused to fire Wooten, Palin's ex brother in law.

The PSEA complaint alleges that the governor or her staff may have have improperly disclosed information from Wooten's personnel records.

The complaint alleges "criminal penalties may apply."

John Cyr, director of the union that filed the complaint, told NBC News, "It seems obvious to us somebody has improperly accessed [Wooten's] personnel file."

According to NBC News, the McCain/Palin campaign provided a family twist to the story, saying the governor's husband - Todd Palin - was the source of that information to Governor Palin's close aide Bailey.

However, in the recorded phone call that brought the breach of confidentiality to light, it appears that the campaign's statement is at odds with what Bailey said in the phone call.

During the 24 minute taped phone conversation between Bailey and State Trooper Rodney Dial, the trooper asks Bailey where he got the confidential information from.

"I used to be a recruiter and I know some of that information is extremely confidential," Dial says.

"I'm a little reluctant to say, but over in administration is where we hold the workers compensation files, right there" answers Bailey.

So which is it?

Did Todd Palin give Bailey the information or did Bailey get it from the files in the Department of Administration?

In a taped interview with Anchorage Daily News Reporter Kyle Hopkins on August 14, just one day after the phone call was released to the media, Governor Sarah Palin stated unequivocably that Frank Bailey acted completely on his own.

"No one ever directed him to make any calls, he never disclosed he made any calls," Palin said.

However, Bailey sent an email immediately after the phone call to a fellow staffer.  

On February 29, an email was sent from Frank Bailey to Ivy Frye just after Bailey's recorded phone call to Alaska State Trooper Rodney Dial.

"Leaving pretty quick for the airport...call me though I need to give you a heads up. Spoke to Rodney and he doesn't get that kind of stuff since he's a Lieutenant, but he'd definitely pass it on."

Not only that, but Palin also told Hopkins that "Todd never told Frank Bailey or suggest he take on this mission to call a trooper."

But now they admit Todd supplied the information to Bailey?

According to state phone logs, Todd Palin called another Palin assistant Ivy Frye three times between 1:45pm and 3:50pm on the afternoon of February 28, the day before Bailey's call to Dial.

But there is more. The Palin administration has refused to release over 1100 additional emails citing "Executive privilege" and "Deliberative Process".

According to the privilege log of those emails that weren't released, there are eleven different emails between 7pm on February 28 and 11:41am on February 29 with the subject line "re: PSEA" sent between Ivy Frye, Annette Kreitzer, Sarah Palin, Frank Bailey, Kris Perry and Todd Palin.

The inclusion of Todd Palin on this email string raises serious questions as he is not a member of the executive branch but yet was kept apprised of the situation.

The new revelation that Todd Palin was the source of the confidential informations begs the question; why would he tell Bailey? Unless of course he wanted to arm Bailey with information before he called Trooper Dial.

Good thing there is an investigation going on so we can get to the facts.

After all, reform and ethics begin at home.

Sick of Palin's Lies

Great job Andrew, I think the majority of us are sick of hearing Palin’s lies and contradictions. First she adamantly denies that anyone made any calls to anyone, then it comes out the Bailey did and others as well. She insisted she and her family didn’t make calls, but that has been proven false as well. But the topper is her continued denial of any knowledge of Bailey or other staff members making these calls yet the email mentioned for Feb 28th clearly shows she had plenty of knowledge. Now she is validating the calls from Todd as well. She is already getting preferential treatment by not being subpoenaed – thanks to other republicans. She “welcomed” the investigation before there was one, then began her own so they could stay ahead of the game. Now that the heat is on she is stonewalling – and the fact that anyone believes she will voluntarily make time to be interviewed is mind boggling. I wonder if anyone has checked or will be checking Bailey’s bank account for the payoff he has or will be getting for taking the heat on all of this. If she wasn’t involved she would have suspended him without pay, but that sure didn’t happen. Maybe she has just promised him a job as her lackey once she makes it to the White House.


The timeline, Andrew. Remember the timeline

Andrew, if you can remember to do so each time a member of the national media contacts you, ask them to ask Palin to fill in one item: Why was firing Monegan so important that it had to be done while she was out of town? She was due back in a couple days, but she couldn't wait to meet with him for some reason. She had a lackey fire him. I understand that Kopp had already been told he was getting the job. Supposedly, she had vetted him (we know that's not true, but whatever). Why didn't she either fire Monegan before she left or after she returned? What did he do that made him not deserve to be told to his face? Do you see how these issues relate to the eerie parallel with the way McCain supposedly vetted Palin?

That must be why the McCain Damage Control Unit is releasing statements that Sarah wasn't aware of what Todd was doing until August... Sarah and Todd obviously only talk to each other about non-personal matters such as moose burger recipes...


There was more in the phone message

Andrew there was even more detail in the phone message because Bailey specifically referred to Wooten not listing on his application for Worker's Comp his prior injury from his military days. So we even if we have heresay evidence provided by Palin's sister thru Todd Palin that "Wooten told me he didn't list his prior injury" Bailey would be unlikely to provide that information as a reason to investigate Wooten unless he felt that the actual Worker's comp file also showed such admission.


Enough of the drama

There are those who say that we should fully support McCain just to get Palin and her "me first" dramas out of here so that the Karl Rove, Republican machine can groom her into what they want, which may include fresh dialog on ANWR and America First populist rhetoric. Many think that she help us more in that way. Yes, perhaps, but only if for once she takes the advise of others over her stubborn "don't tell me what to do" attitude. There are those who said in 2006 that an "R" is an "R" and when the Republican party fully supports her to help her to Juneau, she would be beholding to the Republican party. They (we) were wrong in 2006. Why would she conform to expectations of a party now? McCain needs to dump her now. She needs to come back here and face the music of the mess she has left us. Is she planning to jet off to media star status land and expect zombie rat Frank Bailey take the blame and consequences for her? Or will she blame Todd or others? Expect anyting from her as she advances herself. We as citizens must not expect her to do the right thing. We must make her. Or else, Thomas Paine will be rolling in his grave.


Andrew Sullivan is reporting Todd's former business partner

Has filed a emergency motion to have his divorce papers sealed. Maybe there's nothing in there about Palin and he just doesn't want people snooping around his divorce papers as a result of the Enquirer story. That would seem reasonable right?


Todd = State Personnel?

How can Palin's lawyer claim the investigation should be in front of the Personnel Baord only, when Todd is clearly at the center of this? Given the ludicrous legal arguments coming from Van Flein, we can expect to hear that Tood is a state employee for purposes of stonewalling this matter.


Governor's lawyer should be investigated

Van Flein fits in well with the Palin cabal. He has taken a page from the Governor's play book: the rules only apply to others. Van Flein has argued ridiculously that the Personnel Board has exclusive jurisdiction over the investigation and an independent investigator must be hired. The argument is so weak, his actions show even he doesn't believe it. How was Van Flein, the governor's personal attorney, able to investigate, including taking depositions? According to his own argument, this should be the exclusive province of an independent investigator hired by the Personnel Board.

Thank you for your continuing research into this story. Tremendously important as it directly indicts Gov Palin's claims to truthfulness, or does she only claim truthiness? A lie is a lie is a lie, and there seems to be a long trail of them . . . leading, perhaps, to a bridge to nowhere?
