Rebranding Troopergate: A Seinfeld moment

On Saturday, Governor Sarah Palin phoned in from a campaign stop in Pennsylvania to answer questions, limit one per reporter, from the local media.

Before she opened the painfully limited question and answer session, she prefaced her answers by attempting to rebrand what has now become known across the globe as Troopergate.

"It’s good to get to speak with you. Let me talk a little bit about the Tasergate issue if you guys would let me," Palin said according to an audio of the teleconference with reporters.

Tasergate?

Palin's clumsy attempt to try and rebrand the three month independent investigation into allegations she abused the power of her office is reminiscent of the Seinfeld episode where George Costanza tries desperately to rebrand himself as "T-Bone" to his co-workers and ends up being branded "Koko the monkey."

The challenge for Palin attempting this tortured exercise is that the contents of the Branchflower report released on Friday leaves no room for rebranding this investigation; it is truly a "Troopergate" affair.

After reading the 260 page report it is clear that we know things today that dispel all of the excuses offered by the governor and raise serious questions about the pursuit of Trooper Mike Wooten, the Monegan firing and her management of state government. 

What we know now.....

We know Todd Palin stated in his deposition that he was unaware that Trooper Wooten had been suspended until after Monegan got fired on July 11, 2008.

We know that Walt Monegan testified under oath that Todd Palin knew about Wooten's suspension all along dating back to January 4, 2007 when he met with Monegan in the governor's office. According to Monegan, Palin said he was upset that Wooten got off with a few days suspension, a slap on the wrist, according to Palin.

We know both Governor Palin and Todd have both claimed publicly that they were fearful of Trooper Wooten and only did what they did to protect themselves and their family against a "rogue trooper".

We know that Gary Wheeler, a State Trooper who has been on the governor's security detail since 1981, testified under oath that at no time since Palin has been governor, has her or Todd ever voiced a security concern or fear about Trooper Wooten.

Wheeler also testified that shortly after being elected, the governor voluntarily reduced her personal security detail from six down to three and decided she wanted to drive herself to work everyday.

In fact, Branchflower wrote in his report he doesn't believe the Palins were truly afraid of Wooten:

"I conclude that such claims of fear were not bona fide and were offered to provide cover for the Palins' real motivation: to get Trooper Wooten fired for personal family related reasons.

"We know Governor Palin has stated that she replaced Monegan because he wasn't a team player and she wanted the right person in the position, so she hired Chuck Kopp.

We know according to Kopp's testimony that he was formally offered the job four hours before Monegan was fired on July 11, 2008.

We know that when Monegan was fired that afternoon by Palin acting Chief of Staff Mike Nizich, Monegan asked if they already had a replacement and Nizich replied they had a "short list", when in fact they had already formally offered the job to Kopp hours earlier.

We know according to the testimony of both Monegan and Kopp, that the Palin administration was aware of the sexual harassment complaint filed against Kopp back in 2006 after there was a move to bring Kopp on board with DPS shortly after Palin's election. According to Monegan, Palin Chief of Staff Mike Tibbles, upon hearing the news commented that they better steer clear of Kopp for awhile. 

We know that although Governor Palin told the news media a week after Kopp was hired, that the sexual harassment complaint from Kopp's past was looked into and found to be unsubstantiated; Kopp testified that in the 30 minute interview before he was offered the job, neither Bailey or Nizich asked him about the sexual harassment complaint even though the administration was told about the complaint back in 2006.

We know Kopp testified that when he received a phone call from Frank Bailey in July gauging his interests in Monegan's job, when he asked why Monegan was being fired Bailey stated that "Todd was mad at Monegan."

We know that Bailey told Kopp that the governor had lost confidence in the Alaska State Trooper's ability to protect her, even though she voluntarily reduced her own personal security detail and her security detail testified she had never once voiced a concern about feeling threatened.

We know that both Bailey and Nizich in their initial discussions with Kopp, brought up Trooper Mike Wooten and the governor's frustration that he was still a Trooper.

We know that Nizich brought up the governor's frustration with Monegan not making the state jet available to the governor on demand when in fact Monegan had already supplied the governor's office with data showing the exact usage of the jet. 40% used by the governor, 40% used by the Dept. of Corrections to transport prisoners and 20% split between trooper calls for service and contract work for federal agencies contracted to police fisheries. 

We know that after Frank Bailey's infamous recorded phone call to State Trooper Rodney Dial, he received a stinging rebuke from Deputy Commissioner John Glass.

We know that although Governor Palin told Kyle Hopkins of the Anchorage Daily News that Frank Bailey acted on his own, Glass testified that when he asked Bailey why he would call a Trooper outside the chain of command, Bailey responded that Governor Palin "felt good and was comfortable' about Dial because they had attended the same church in Wasilla.

We know that Glass went on to testify that he felt that the phone call from Bailey to Dial was a result of a conversation that the governor had with Bailey and that he felt when talking to Bailey about the phone call he was talking to the governor. We also know that during Bailey's taped phone call to Trooper Dial, he mentioned more than once he was calling on behalf of the governor and Todd.

We know that Monegan, Glass and others warned both the governor and Todd about their pursuit of Wooten. They were warned about the legal consequences of illegally pursuing a classified employee and attempting to violate his rights.

"This conversation is discoverable ... You don't want Wooten to own your house, do you?" Monegan warned Palin's Chief of Staff Mike Tibbles once.

Another exchange had Glass warning Bailey that continuing to pressure anyone and everyone in the matter would end in "an unbelievable amount of embarrassment for the Governor and everybody else".

The real story...

The pursuit of Wooten wasn't about a fear for the safety of the first family, it was an attempt to get him fired so he couldn't pay spousal support and Sarah's sister (Molly) would get custody of the children.

During the custody battle, Molly had asked for 55/45 custody and Mike asked for 50/50. Judge Suddock ruled that Molly was under employed and he didn't see the fairness in making Mike pay for Molly's refusal to work a full time job.

According to Branchflower's report, Judge Suddock was forced to comment on the ongoing situation where the Palin's were trying to get Wooten fired.

He went on to say that the Palin's relentless attacks on Wooten should cease and they should remember Aesop's fable about slaying the golden goose. "For whatever reason, people are trying to slay the golden goose here and it tends to diminish his earning capacity."

At the end of the day, Judge Sudduck granted 50/50 custody much to the displeasure of Molly.

We know that both Governor Palin and Todd had an obsession with getting Wooten fired to get even while benefiting her sister. This wasn't about an effort based on concerns for their own safety or the safety of their family, that much we know for sure now.

In finding Governor Palin guilty of abusing her power as governor, Branchflower concluded:

"The evidence supports the conclusion that Governor Palin, at the least, engaged in "official action" by her inaction if not her active participation or assiatnce to her husband in attempting to get Trooper Wooten fired (and there is evidence of her active participation). She knowingly permitted Todd Palin to use the Governor's office and the resources of the Governor's office, including access to state employees, to continue to contact subordinate state employees in an effort to find some way to get Trooper Wooten fired."

But more importantly, we know now that  Governor Palin's press release on July 18, stating;

“To allege that I, or any member of my family....directed disciplinary action be taken against any employee of the Department of Public Safety, is, quite simply, outrageous"...

....was, quite simply, a lie.

Separate all the fluff from the substance and what you have is one man saying he thinks Sarah Palin should have told Todd Palin to back off a little sooner. That's it, that's the takeaway from this whole deal. Cue Peggy Lee.

If you are employed, would

If you are employed, would it be okay with your boss for your spouse to hang around, use the company equipment and disrupt other employees with personal matters on company time? No? I didn't think so. Taxpayers are the governor's boss, so it's a little disingenuous to suggest that only "one man" has an interest here. If you are okay with Sarah and Todd Palin using state offices for personal resources, despite the fact that it is illegal (and, incidentally, didn't Sarah make a big deal about "cleaning up the Energy Board" because someone was using state resources for personal campaigning?) you are the one who needs to explain why this was okay. If Sarah couldn't abide a political rival doing it because it was unethical and wrong, how was she so comfortable with her own husband doing it.


Not Quite

Like Sarah stating she did not do anything unethical, you're parsing. In other words, basing conclusion on some but not all fact, especially those facts that would lead to an opposing conclusion. There's more to it. Sarah actively tried to get a State employee fired. It wasn't just Todd needing to be controlled sooner. Also it had to do with Sarah knowing what was going on from the start. Which amounted to her INACTION for EACH of Todd's actions being in and of themselves unethical conduct. And of course there is more in the report. Aside from this, note that Sarah lied to Alaskans in many media interviews when she denied her knowledge of events, among many other things. These lies were not violations of the State ethics code, but they were unethical as per social norm. This sort of conduct inflames many who otherwise would support her.


Oh, but there's so much more...

Open your mind, Jim. There is so much more to take away from this whole deal. If only Gov. Palin had the good sense to be gracious in admitting that she abused her power to try to settle a personal family score right from the get go, this whole deal would have been over with months ago. Instead she chose to lie about it. A little apology and a few hits from the legislature, media and bloggers, and it's over. Way back then, people loved her; all would be forgiven. Unfortunately, Gov. Palin was not smart enough to understand that honesty is always the best policy; lies will always come back to bite you. I, for one, expect way more from my elected public officials. I expect smart and honest... This report shows that she is neither.

Question about Branchflower

Thanks for your blog - it's been very useful to those of us outside of Alaska to learn the facts through the constant fog of lies. I notice that you are good with replying to comments and so I hope you can clear something up for me. I keep hearing the McCain/Palin talking heads make the (transparently false) claim that the report is "partisan". Part of their case rests on claims that both French and Branchflower are Democrats and Obama supporters. In French's case, his political affiliations are in the public domain, but I can't find anything about Branchflower. I've reached the point where if I can't find documentation of a Palin claim, I just assume it is a lie. And sure enough, watching a clip of Les Gara confronting Stapleton, I hear (from Gara) that Branchflower is a conservative Republican. Is this true? If so, it needs to be broadcast more widely, since the Palinites have been asserting the opposite at every opportunity. (By the way - before I moved to the States and became a citizen I worked for many years with TransCanada. So I guess that makes me an honorary Alaskan, right? Hence my screen name.)

You can't find any evidence so you assume the partisan charge is a lie. I can't prove that robots aren't coming into your house and stealing socks out of your dryer so that must be the case. After all, I can't find any evidence. But let's start with a couple of facts that some of the electric visitors from the South may have missed: 1. Walt Monegan was chief of Anchorage Police Dept. While Walt was head of APD, Linda Branchflower, Stephan's wife was an investigator for him and worked in the cold case division. 2. While Walt was chief of APD, Stephan Branchflower was a prosecutor and worked very closely with APD bringing their cases to trial. 3. Hollis French is a liberal Democrat from West Anchorage with designs on higher office. He has made several public statements supporting Obama and has contributed to his campaign. 4. Read the McCain campaign's release on Troopergate; they have a transcript of an interview given by French in which he essentially had already convicted Palin before the investigation began. 5. Les Gara is a maxed-out Obama donor.


You prove my point

You prove my point by blathering, Palin-style, about everything but the question I raised. I said that I was assuming that what the McCain-Palin group have been saying - that Branchflower is a Democrat - was a lie. It's a simple question: Is it a lie or isn't it? Rather than answer it, you go on for dozens of lines about other things. Apparently, then, it *was* a lie, and you are just trying to change the subject. I said that French's affiliations were part of the public domain, so I don't know why you say that 3) and 4) are things that I would have missed. I didn't know about Gara's contributions (5) but it doesn't surprise me. Those are two of the fourteen members of the committee. Ten of the others are Republicans. Ten Republicans and four Democrats does not a "partisan" panel make, even if two of the Democrats have contributed to Obama and think he would be a good president. Or are you suggesting that an investigation can only be "fair" if *only* Republicans can be involved? A ten to four majority isn't tilted enough in your favor? You say that Branchflower and his wife worked with Monegan. I expect that they did. I grew up in a family of police officers in an area about the size of Anchorage. I can tell you that it is impossible for any two people working in law enforcement or the prosecutor's office to go for very long without working together for some stretch of time on something. So whatever independent prosecutor you chose - Branchflower or anyone else - would have some such connection to Monegan. Pointing out that they worked together is just a smokescreen. But all this is secondary: the basic fact is that the report is incredibly damning. It was prepared by a serious career prosecutor who is - you have not denied - a conservative Republican. If you keep raising a smokescreen of accusations of partisanship it can only be because you can't quarrel with the substance of the report.

Thanks for bringing this up. I've been a little confused about why the legislators and investigators don't squash this partisan nonsense, too, since it is pretty easily refuted based strictly on the facts of the case. Another interesting, and in some ways unfortunate, thing is that the independent investigator hired by the Alaska Personnel Board to run the "other" investigation--the one that Sarah agreed to cooperate with--is a Democrat, so the right wing will just denounce that report, as well. Have we really reached this point in our country where there is so little faith in the justice system that any and all illegal and unethical behavior can be justified by claiming that holding someone responsible for their actions is partisan? I know the gov CAN appoint (and fire) members of the personnel board, but it has not been stated whether she DID appoint the current members. Does anyone know? I'm thinking that the fact they immediately went out and hired a Democratic investigator indicates that (to their credit) they understand the appearance of favoritism since they are Palin appointees and they wanted to remove any question of pure partisanship. Unfortunately, they may have inadvertently played into the hands of her "truth squad."

What baffles me is that AK elected her in first place. I would love to see AK go BLUE.


No kidding. Alaska's pretty

No kidding. But Alaska will most likely never go "blue". Although in a twisted kind of way, Palin is somewhat "blue" as her economic policies in AK are anything BUT fiscally conservative (i.e. not what one considers Republican). She floats along with her popularity meter, and in her tenure that has meant tax and spend (e.g. oil taxes raised to highest on the globe, and a $500million incentive payment to TransCanada for a pipeline with no guarantees). Now that she's been exposed as a fluidly changing purple tinged with green (for the ethically challenged), I really don't know where she fits in the political arena!

Palin the Liar

I am truly a disappointed Republican. I for one am wondering who in the Legislature is going to take a look now at the State Trooper Budget and Fix It. Palin will be back in November - mark my words. It shows more and more everyday she is hurting the ticket. With our economy in dire straights all she can do is hold rallies. She cannot help him discuss the issues because she knows nothing. When she gets back who is going to make her and King Todd obey the law at least? My guess is she will be cockier than ever. PS - Is Colburg off the hook?


legislature needs to step up to the plate

I hope the legislature finally takes charge this spring, and doesn't just take the governor's budget numbers at face value, but does a little digging to find out just which agencies might need a few more resources to do a proper job protecting and serving Alaskans' needs. THEN the legislature needs to back up their budget with veto overrides if the gov tries to shaft them for the third session in a row.


Everything I've heard about

Everything I've heard about Sarah Palin in the last few weeks is simply shocking and nauseating. The words that come to mind to describe her: deluded and suffering from a sense of entitlement and HUBRIS (because she was a state basketball champion??? and a beauty pageant participant??). The recent TIME article says it very well. The only mature person who testified in the Branchflower investigation was Monaghan. He tried to tell these morons to cool it, to back off. But they felt entitled to get this guy fired and really did not care if they were breaking the ethics laws. How ugly. What an embarrassment to all Alaskans, that we have leaders so stupid to govern like this. I feel humiliated and embarrassed. Because she is a big fish in Wasilla, she thinks she can get away with such unprofessional behavior nationally. If she doesn't fall NATURALLY on the policitcal scene (which I hope) I can always rely on KARMA. This woman has some major bad karma coming!

It's Obvious

Because Sarah, Tallis, and the McCain campaign denied Branchflower the ability to receive their testimony by stonewalling. If they wanted their knowledge of the case recorded, they should not have excluded their testimony by obstructing justice.
