Today, Governor Palin's aide Frank Bailey who was put on paid state leave for making a recorded phone call to Alaska State Trooper Rodney Dial in an attempt to get the governor's ex brother in law, State Trooper Mike Wooten fired, was scheduled to be deposed by independent investigator Steve Branchflower.

However Bailey lawyered up and cancelled his appointment. This is unfortunate and shows the Palin administration is no longer cooperating in an investigation that they have promised all along to cooperate with.

In fact it was the reason given why Bailey was put on administrative leave and not fired according to the governor's office. It was so he could be compelled to cooperate with Mr. Branchflower's investigation they said at the time.

"Alaskans should be offended, that Frank Bailey is on paid leave and will not do an interview that he already committed to with Mr. Branchflower," said Representative Jay Ramras, a Republican from Fairbanks and the chair of the House Judiciary Committee.

"My intention is to call Chief of Staff Mike Nizich, who is an honorable man, and tell him he better kick Bailey in the butt and get him over here, or else he will be asking for scrutiny. We have a million people from the national media here. Alaska does not need to air its dirty laundry in a public way," Ramras told KTVA News.

So while the Judiciary Committee is considering issuing subpoenas for Mr. Bailey and others, there is another question lurking out there that no one is asking about:

Why was Chuck Kopp paid $10,000 when he resigned?

Three weeks ago we broke the story about a $10,000 severance package that was quietly given to short time Public Safety Commissioner Chuck Kopp who was hired just days after former Commissioner Walt Monegan was fired. 

Kopp resigned after just two weeks on the job after public and media pressure about a prior sexual harassment complaint filed against him in 2005 refused to go away.   

Until we broke the story, the severance agreement was never mentioned by the Palin administration. In fact  it was not publicly known until the Attorney General was questioned about it at a later press conference.

Attorney General Talis Colberg defended the severance pay by claiming that Kopp left a comfortable 19-year career on the Kenai Peninsula and took a job that lasted less than two weeks.

Colberg's explanation raises some questions.

First, the governor stated in the press on August 1 that she was surprised and disappointed to find out that Kopp had in fact been issued a letter of reprimand. Before it came out in the media, Palin stood firmly behind Kopp. So why, if this whole downfall was caused by Kopp being less than forthcoming about the letter, would the state pay him 10k as a severance?

Second, hasn't the governor been defending her firing Monegan for the last four weeks by saying that commissioners are at will employees and can be fired for any reason? So if she can fire a commissioner for any reason without paying them severance, why would she feel obligated to cut Kopp a check for $10k when he quit.

To put this into perspective; Monegan was on the job for 74 weeks and received no severance pay. Kopp was on the job 2 weeks and received $10,000 in severance pay.

Third, the agreement specifically states that the $10,000 is "not compensation for lost wages." So if it's not based on lost income, why is Colberg leaning on the argument that it's necessary because he gave up a good career for a job that only lasted two weeks? 

Furthermore, Colberg had no logical explanation when he was asked about how they arrived at the $10,000 figure. 

Something is not right here.

In addition, according to the agreement (attached) Kopp signed a release that prohibits him from asserting any claims "against the State of Alaska, its officers, employees, agents, representatives, insurers, servants, successors in interest..and demands for damages, costs, expenses or attorney's fees that arose" related to his employment.

This guy supposedly quit on his own. Why would the state need to pay him ten grand and require a signed release from future claims of damages?

And exactly how much did $10,000 buy the Palin administration in liability protection from Chuck Kopp?

The only reasonable answer could be that the Palin administration recognized that Kopp had significant grounds for future claims surrounding his hiring, short tenure in office and subsequent resignation. Or it could have been just old fashion payola to get him to go quietly into the night.

The importance of "transparency"

First off,I just want to say thanks for putting your neck in jeopardy with this blog. For posing some serious questions that really have to be asked. I am a 14 year resident of this fabulous state. And my question is what happened to the Hickel Palin relationship? When she was running for Govenor, Wally used to escort like a debutante throughout the Cook. A couple of her ads were shot with the Cook as a prominent back drop. His alliance gave her certain credibility. Rumour has it that they stopped speaking. In fact his recent endorsement on the local news was tepid at best.

The real question(s)

Fantastic Blog is all I can think of as I stumbled across this site surfing the web tonight. After watching John McCain's acceptance speece for the Republican nomination for President I was moved. Noteworthy pundits across the U.S. have long known that John McCain is not too suave with the language and he proved that tonight in his ill prepared acceptance speech. As was most likely recommended by his staff writers, McCain went into a 15 minute drivel about how his running mate is the best choice he could ever make after the fact and then ranted about how she is such a good mother. Over the past couple of days I have been reading other bloggers and web news sites and I couldn't help but notice some of the negative stories swirling out there like trash in a wind storm about the character of the now former govenor of Alaska and her shaky political and business practices. It seemed trivial at first, however as I often do, I searched the real sources and that being the local press. I learned quite a bit about Alaska and the bully from the north. I am quickly getting aquainted with the story of Mr. Kopp. the payoff and the real question. I am sure there is more to come in this now juicy campaign. After witnessing her acceptance speech last night and being amazed at how articulate she can become in denouncing her advarsaries, trouncing her opponents as if she knew them personally, and also observing the crowd at the RNC seemingly stunned by her words as well, I now I must agree with the opinion of the journalists of the state of Alaska in their conclusion that this woman is not ready for the VP spot to serve our nation. Moreover, I would be safe to say that the surprise factor of her being chosen has worn off and her brash character may not really matter anymore to most voters. I would be surprised if John McCain wins this election. I don't think at this point (after his bumbling speech) that the choices are blurred anymore. The clear cut choice for this nation to get us out of this mess that the Republicans have led us into over the past 8 years is the Democratic ticket. For the Republicans to blame the ills of America on business as usual in Washington is shameful. They are just outright irresposible and refuse to take any responsibility for the mess they voted for time and time again.


Thanks for truth. The Palin

Thanks for truth. The Palin is looking to make it to the big time. and appears to have a huge ego and she will attempt to take out anyone or anythng that gets in the way. But truth can be repeated again and again the lies will cause "one to fall".


Clarification

We only WISH she were our former governor. However, despite no longer performing her duties as governor (like our lieutenant governor and the mayor of Anchorage, who also have been on paid hiatuses while they pursue more glamorous elected positions), she continues to collect a state paycheck and hold the title. Her offices in Anchorage & Juneau will be waiting for her on Nov. 5 ... unless, of course, she follows her own advice to others who have been investigated for crimes in office and resigns.


release dates?

Did anyone else notice the two dates on the release form? Looks like the acting chief of staff, Michael Nizich signed on 7/30/08 and Kopp didn't sign til 8/02/08. Sounds like "pressure" again.

Alaska's sovereign right to investigate

It is pretty clear that McCain/ Palin are trying to kill Alaska's ethics investigation. Bailey bailed and Palin probably will too. I'm no attorney, but I wonder if their plan goes something like this: 1. Refuse to testify. 2. Get subpoenas. 3. Challenge legislature's right to subpoena in court-- claim they don't have jurisdiction as this is a matter before the personnel board. 4. If court challenge is won, stall with personnel board or even withdraw the governor's request for an investigation there. And on and on . . . People wonder what all those McCain/ Palin attorneys are doing in town. Perhaps they are hard at work poisoning our state's sovereign right to scrutinize its chief executive. I wonder if they have communicated with members of the Senate Judiciary Committee. If so, I wonder if there is still a majority of committee members who would advocate a subpoena of the governor. If the committee won't move forward, this investigation may be dead in the water, and truth and transparency in government may be just a historical icon.


Bailey was advised

I've no doubt Bailey was advised to retain counsel. Who is his lawyer and who is paying the bill? Last night, Tom Brokaw and Keith Olbermann both agreed that Troopergate is just a "bump in the road" for Palin. They both believe it has little to no merit and is simply an administrative problem.


I really want to like Sarah...

As a registered Republican, I want to like Sarah. The R ticket however has become a huge disappointment to me. McCain had a chance to fill some of the voids that he brings to office and I believe he failed to do that. I guess he was going for the rural vote but didn't satisfy voters like me. Unfortunately I feel forced to vote Republican to stop the likely onslaught of Democratic big government reforms. If McCain-Palin do win I think it will be a fiasco though. This again is the lesser of 2 evils election for me.


You can characterize it as

You can characterize it as "old fashion (sic) payola" if you wish, just for the impact of it, but I'd be surprised if someone with your experience can't recognize it as possibly - if not likely - just plain good business. As a CEO, I have a number of times been in the position of having concluded to release an employee whose performance has in some way become substandard in my view. But when the available measurement of that performance - as in the case of "intellectual" or administrative, as opposed to "physical" duties - is basically subjective, who knows where today's employment law climate might lead us? And that question becomes even more problematic if the subject is someone with significant "courtroom appeal". So I certainly don't have to "know" that the subject has "significant grounds for future claims" against me. I can simply reason that if (s)he files something it will cost a minimum of $XThousand in legal fees just to get it dismissed, the BEST possible outcome. So I'm more than willing to pay up to $XThousand, maybe even more, to secure a valid and ironclad release. I realize the threshholds and other considerations might be somewhat different in the public sector, but I believe the principle is the same. I am NOT a Palin fan, and I'm disgusted with the whole Wooten/Monegan/Kopp/Bailey/Van Flein/French/Branchflower goat-roping event. But your presentation of this matter simply undercuts your credibility on others.


Question for "been there"

Good point. But if this indeed was just "good business," or as you define it a good and common business practice, why was this same benefit and contractual obligation not given to Walt Monegan? In hind sight paying him off might have benefited Palin's office more. Mr. Halcro, what do you know about this? Was Walt Monegan offered a similiar severance package (with strings included) and opted out or was there absolutely no offer made? Also, have others terminated during her term in office received such generous settlements? Seems unlikely.


I can only speculate - I am

I can only speculate - I am not representing this to be an informed response. I would think Monegan (as well as others who have been terminated) would be a pretty "safe" situation; quite clearly an "at will" employee, a gubernatorial appointee, and 19 months or so of service and opportunities for evaluation, as well as (allegedly) the offer of an alternative position. [I agree that, with hindsight, the Governor may very well wish she had "bought" a release - in which case, I would also agree with Mr. Halcro's presumed characterization of THAT payment as "payola"!] It seems to me Kopp's case could be more problematic - potential assertions of having been "enticed to leave a well-paid and well-regarded position", "insufficient time for observation/evaluation", "reaction to an issue which was a matter of public record", "you never asked", and possibly more. Again, this is only speculation, as was the basis for my first comment - my essential point is that the facts (when/if they are established)can and do speak for themselves; gratuitous and inciteful characterizations are unseemly and tend to weaken the speaker's stature.


Palin Club Rules

Andrew. You're not following the rules. We don't like people not following the rules. The rules are: #1 - The first rule of Palin Club is, you do not talk about the Palin Club. #2 - The second rule of Palin Club is, you DO NOT talk about the Palin Club. #3 - If someone says stop, goes limp, taps out, the Palin inquiry is over. #4 - Two guys to a Palin inquiry. #5 - One Palin inquiry at a time. #6 - No shirts, no shoes, just flannel and Xtra-Tuffs. #7 - Palin inquiries will go on as long as they have to. #8 - If this is your first night at the Palin Club, you have to investigate. Don't make me have to go over the rules again with you.


...this is the CHARACTER issue I'm talking about...

Andrew, this is yet another example of the CHARACTER issue when it comes to Sarah Palin. She is utterly problematic in this regard, and at the end of the day, this will become the substance of the discussion when it comes to Sarah Palin. Because if you were really listening to her speech at the RNC last night, you didn't hear anything about the REAL ISSUES facing our country in this political season: where was healthcare reform? how about tax reform for the middle class? where was the Republican plan for delivering us from the mess in Iraq? where was the economic and energy policy plan? The Republicans are making a huge mistake with the character attacks against the Obama campaign. It's going to come down to character, obviously, and all of this bluster about experience is a red herring. And WHEN it comes down to CHARACTER, the Republican's mistake will become ultimately clear. The list is growing. Paying off Kopp to keep quiet about Palin's obvious blunder in choosing him as a replacement for Monegan is just yet another example of why she makes no sense as a governor, and why she makes even less sense as a serious candidate for a serious national office. Sarah Palin is one gigantic CHARACTER FLAW -- it's hard to suppress the laughter when you try to envision her in DC... Her lack of awareness/blind spot (when it comes to doing whatever Sarah wants because Sarah wants to...) will be her undoing. I can't wait to read about it all in the national tabloids and rags. It'll be fun collecting them, and putting them in a box (in protective plastic sleeves, of course) so I can pull them out 30 years from now and E-Bay them to political junkies who remember the Palin disaster of 2008...


Bailey

Andrew, Palin is still alive and well and trying to cover her lies. I know the media is watching. They should contact AST and in addition to showing the lies of the Governor and this Administration. Look at what her resentfull budget cutting has done to Public Safety here in Alaska. So is she fit to have something to do with National Security - I guess as long as they don't make her mad. Who is in town and who can we contact.

Does this remind anyone else of Mr Whitekeys's bit on KTUU a few weeks ago? He said he wished he was a polititian at the national level so that he could fire his brother-in-laws all over the country. Is this what Palin is angling for?


Alaska fell for a pretty face

Is the South 48 going to follow? This story just gets worse and worse. The thing is, she could have handled this so much better. She could have marched bravely out in front of the television cameras and said, "I love my sister. I lost my temper. I made a mess, and now I have to clean it up. I let you down. I won't let that happen again." To a man, woman and child Alaska would have forgiven her on the spot and this story would have become nothing more than a footnote. Now everybody's lawyering up and things look ten times as bad. What is it with politicians that they can't admit to and atone for a mistake? Now I'm worried that Senator French's investigation is going to be derailed for the duration of the election, and then what? It'll be a big mess for a sitting vice-president, which doesn't remind me of Harry S Truman, it reminds me of Spiro Agnew.


You might be right

The thing is, Palin's ego won't allow for her to say she's less than 100% correct on things, especially when her errors reflect on issues of integrity and ethics. She sold Alaskans an image, the way she's selling the whole country, of the anti-politician. I don't think French will just roll over and allow these guys to steamroll him, but if Van Flein buys time past the election, it's over...well, unless the Dems win, in which case you can expect her to either resign or be impeached. I really don't see it turning out any other way.

The den of vipers on this blog would do nothing of the sort... there would have been a chest thumping of epic proportions! This investigation is not over yet, don't count your chickens before they hatch... you all are judge and jury and have already issued your decision that "crimes have been committed" If and when she is cleared of these charges... what will you all say then? I hope you all apologize with the same intensity as you exhibit in your accusations of guilt... somehow I think that isn't going to happen.

Clearly

I won't apologize. Why would I? She said her and her staff didn't talk to Monegan, I said she was lying, she released a recorded converstation of Baily talking to Monegan. Pretty cut and dry. She is still lying. She 'by gawd' wanted Mike Wooten fired for real or imagined threats and she was going to get Mike Wooten fired 'come hell or highwater'. Even the most gulible of children should be able to see plain as day at this point what Palin's intent was. With even just 1/10th of the evidence, you should be able to, like her or not, see that she tried to get Monegan to fire Wooten. There is not a doubt in my mind this is what happened.

Andrew, I can barely bring myself to read all of this anymore. I am sickened beyond words. Somehow Palin wiggles out of everything, people look the other way and no one has the guts to stand up. Frank Bailey, you lied to the cameras and you are slinking off now. How much more of this is this State going to take from this administration?

And it's so irritating that even the media (and they did it again last night) when they bring up the domestic violence by Trooper Wooten against his wife....they always fail to follow up by saying that Trooper Wooten was in Portland, OR with his STEP-SON when Sarah marched Molly into the Palmer courthouse to obtain this restraining order. And that Judge Suddock then dismissed it when Molly said in open court that Trooper Wooten never hit her or the children or anything like it and that she was pressured by HER FAMILY to file. Hmmmm....


Need Court Records!

If Judge Suddock did dismiss the request for a restraining order because Molly (Sarah's sister) said her husband never hit her or their children, and was pressured by her family to file for a restraining order... Then the media should get ahold of the court records for this hearing, instead of constantly repeating all the trash that comes out of Sarah Palin's mouth. Where is the media when you need them!


Stomach churning

I have to agree. The "transparency" in the Palin loyalists is of a type we really didn't bargain for: they will stand in plain view and absolutely refuse to answer a straight question or give an even plausible explanation for what transpires in their office. It's a bit maddening to have to watch this, especially as Outside they're being fed an image of a "reformer" who has merely substituted "self interests" for "special interests". This is more brazen than even Murkowski could have been.


Sick Too

I have been sick to my stomach since Friday morning. And, yes, thank you Andrew. I sure hope she is exposed -- it does not seem that anyone is paying attention to her lack of experience and corrupt behavior. Seems eerily like George W. Bush and his mediocre raise. I am sick about her being nominated and possibly having a future in national politics. I have faith that you and the national media will continue to expose her but a small part of me is SCARED TO DEATH that she will some how slide through and be the VP. If that happens God help us all.

Andrew, Thanks for the solid info supply on this unknown in the lower 48 politician. Kudos to you for keeping the kid's out of it, but I have to wonder if you have commentary regarding the alleged affair being put out there by the tabloid that recently, and correctly, called John Edwards on his mess.
