Walt Monegan returns the fire

In a bold move, former Public Safety Commissioner Walt Monegan filed a request with the personnel board on Monday for a "Due Process Hearing To Address Reputational Harm", inflicted by Governor Sarah Palin.

Monegan's attorney Jeff Feldman wrote in his filing that while Monegan does not contest the goveror's right to discharge him from his position as commissioner, the governor is not entitled to make untrue and defamatory statements about her reasons for discharging him.

"The factual questions raised in Governor Palin's complaint to the Personnel Board are closely related to the factual questions raised by Mr. Monegan's consititutional right to a hearing that will provide him the opportunity to clear his name and redress reputational harm by publicly proving that he was not a rogue employee or grossly insubordinate, as the Governor has alleged, and that he was not terminated as Commissioner of the Department of Public Safety for those reasons."

In a 65 page addendum, Feldman breaks down every accusation about Monegan's behavior and refutes the false claims about Monegan being a rogue commissioner. In one exhibit, emails are provided to show that Monegan's trip to Washington to seek additional federal funds for Alaska's high rate of sexual assault -that Governor Palin called "the last straw" - was in fact approved and a product of almost eight months of coordination within the administration.

For more on this story...tune in tomorrow to my radio show for a complete discussion of Monegan's filing and the detailed evidence presented to refute the governor's charges that Monegan was a "rogue employee" and was "egregiously subordinate."

Alaska, the US, and the world

I have only been to Alaska once, and that was just for a few minutes. But I have learnt a great deal about it by studying different aspects of it. The glaciers and mountains particularly, but yes, also the natural resources. Alaska has taken on a new role in the global scene because of the nomination of its governor to high office. Going from nearly total obscurity to international prominence in one day is bound to be a heady experience, so we can safely assume, I think, that your governor has not yet quite grasped the gravitas of her situation, but I say that only out of fairness to her as an individual. As a public figure she has failed in the most fundamental ways and she should be taken severely to task for her transgressions. In everyday life we all encounter people who are petty and egotistical to the extent that they can never see the other side of a question and temper their certainty to a degree such that some reasonable conclusion can be reached. We tend to avoid such persons, they become isolated, they become outcasts. For the most part. Some, however, become ideologs and find in their isolation a kind of perverse strength, the ability to manipulate people. Those few who hone this skill to a fine edge most often seem to become politicians. Not all politicians behave this way, and not all manipulative people are politicians. But it certainly appears as though, the majority of dishonest politicians, have the skill of manipulation. I do not think the dishonesty of politicians in Alaska is particularly remarkable, it is probably similar on various measures in several other states as well, if not a majority. As long as politics is all about money and power, it will remain so. The entire world is watching what is happening in Alaska even if the majority of people in Texas are not. Show the world that you are what the US truly stands for and represents. To the opponents of openness and honesty in government who are unwitting accomplices to the nefarious deeds of their political figure heads, I would say one more thing. If you are cheated by the market vendor who sells you a one ounce bag of gold that is half full of sand you have no recourse. There will be no restitution. But you harm yourself twice if you refuse to admit that you were cheated. Because by doing so, you subscribe to being cheated again. You have already been cheated twice in the past 8 years. Live and learn.

Honesty, folks

This has nothing to do with Walt Monegan or his reputation. This is all about dragging the case out as long as possible to attract the maximum amount of negative attention. All this stuff will evaporate on Nov 5.

Wrong

Actually it has nothing to do with negative attention for the election. You and everyone with half a brain knows that. The investigation was started before the gov was picked for vp running mate. We all know this. Without this event the investigation still would be underway. We all know this. Those that say it has something to do with the election are Palin supporters that seek to defend her by doing what she does best...knowingly make incorrect statements.

If it were legal, that's one I'd bed against.

When I read the report I had the feeling that Monegan and Wooten were the most stand up people involved. Moegan above all because he even tried to warn the anti-Wootenites to stay out of the business since they had no legal right to know. If I were Monegan, I would do this and if they did not compensate for the damage to my reputation I would persue the next legal recourse. If I were Wooten, I would use the findings to get more custody of my kids if I could.

Facing the music

Jimmy, There is an old axiom in politics. It's dangerous to trade old friends for new friends. That's exactly what Sarah did. If Obama wins, I think she'll find her new friends will take their ball and go home. She better hope her old friends will play with her again, or she's going to have a tough road ahead of her.

You're wrong

Wrong, wrong, wrong... I was just going along taking in all the hoopla over Troopergate, thinking that it was just so stupid for Gov. Palin to not just say "Look, maybe I over stepped my boundaries, but I let my emotions get the better of me because I'm afraid of the big, bad trooper," when all of a sudden, Meg "Just Call Me Hateful" Stapleton appeared on the national stage calling Walt Monegan a rogue, insubordinate, out-of-control employee. Please! I can't just sit back and let the likes of you and the Palins totally distort reality to suit Sarah's overly inflated political ambitions. I don't care what the date is... I will never forget how atrociously the Palins have treated a fine public servant like Mr. Monegan for their own personal gain. It's despicable.

Jim AK

Jim, please dont weep for Sarah and Todd. They would not want you to remember them that way. Go out and shop, buy some new clogs and be happy. Go see "Riverdance"! Sleep good tonight sweetie. The pain is over.

Monegan for Governor

Her favorite word is "reform." Oh, and "maverick." If she is the reform, how bad were things in Alaska government before? I hope Alaskans clean house after this. Walt Monegan would be the first honest governor in my lifetime.

a funny thought

just occurred to me. Based on Wikipedia (which, granted, is a little loose), here are a couple definitions you'll find amusing considering the Palin camp's posturing: In modern English usage, the term "rogue" may be used to describe an independently-minded person; one who rejects conventional rules of conduct in favor of following personal values. A maverick is an unbranded range animal, especially a motherless calf; it can also mean a person who thinks independently; a lone dissenter; a non-conformist or rebel. Hmmm...so what exactly was her problem with him again?

If Sarah is recalled, impeached, removed, etc...

This conservative would propose Choice 1 - Andrew Halcro Choice 2 - Ralph Samuels However, I would want their assurance that they would remove at a minimum commisioners Irwin, Rutherford, and Galvin. Andrew - would you make this campaign promise?

Just a question

At the time of the statements that supposedly damaged his reputation, Monegan wasn't a State employee. Feldman and Branchflower both agree that Palin was well within her rights to fire him. And my understanding is that Monegan was offered a different position and resigned.... So how does Monegan get a hearing when he wasn't an employee when the damaging statements were made and he wasn't illegally terminated? Monegan may have a civil case - I doubt it - but he doesn't have a right to a hearing with the personnel board.

Jim, Jim, Jim

Using your broken logic, only State employees are subject to a hearing from the personnel board. So how is it that Todd, who unlike Monegan has NEVER held an official position with the State of Alaska, can demand that he'll answer only to personnel board? You're about as consistent in your logic as the Palins Wait...is that you Todd???

Think

The Personnel Board is investigating a current State employee, Sarah Palin. I was a State employee 25 years ago and, now that I think about it, one of my bosses may have screwed me over. Would the Personnel Board hear my case?

Um

Why would they?

Your comment makes no sense.

Jim, Jim, Jim... I think

Jim, Jim, Jim... I think Walt's excellent attorneys, Jeff Feldman and former Justice Brynner might just know a thing or two more about the law than you or I...so I would err on the side of caution here and not get your panties in a twist over whether he can or he can't. Would love to chat more, but am off doing research in whether it will be best to attempt to recall or impeach our little caribou barbie and her bully Ken...er, Todd.

Recall AND Impeach!

I know you guys in Alaska have a few great Community Organizers & Attorneys who will work Pro Bono to start a RECALL. During the process of gathering signatures, start writing to your legislators to request that they come back into session - NOW - and start IMPEACHMENT proceedings. McPalin is down 14 points in the polls. On November 5th the Straight Talk Express will be dropping her sorry ass off at the Governor's mansion. Do you really want that?

Training Wheels or One-way Ticket from Juneau to Wasilla

If Sarah isn't in the Whitehouse taking political science night courses by late November, I'd like to see the state of Alaska rally to get her to go back to fishing and hunting in Wasilla. We need to rebuild the economy and oil and gas industry in Alaska. While she "knows more about energy than anyone in the United States" (according to John McCain), she knows less about oil and gas than anyone in Alaska. John was referring to the lower 46 states (cannot include Texas or Louisiana of course).

Small Town Politics

One thing that becomes obvious in this whole charade is that Alaska is one big small town with minimal separation between people. I feel this way every time I go to the grocery store, and Monegan as well as Wooten's children must feel very conspicuous right now. For this reason, I think Monegan has a right to complain about what this has done to his reputation and how it might damage his job-hunting prospects. And Wooten likewise would seem to have a case against the Palin's for alienating the affection of his children. (I know he tasered his child, but if he is truly unfit for parenting and seriously abusive, I believe the Palins would have pursued that case in court already.) IMHO, the volatility of the firing narrative is the centerpiece of Monegan's argument against Palin. Her original press release had no substance, and her press secretary kept spinning new yarn as the weeks rolled by. The character smear against Monegan was a direct result of defensive posturing on Palin's part, exaggerated once she was tapped for VP candidate. The collateral damage to Monegan's character was incidental to Palin's political ambition, and if he can document that her charges against him are not supported by the record, he might have a case for slander or defamation of character.

So true - AK is small

If I am every pulled over by Wooten, the first thing I'll ask as I'm digging for my license is, " been drinking today officer?" If I'm hunting, I'll ask if he knows a good place to fill out my wife's cow permit. If he's writing me a ticket, I'll ask if he'll let me off with a warning if I let him tazer me.

Joesixpack???

JimAK did you change your handle here? Or...is that you, Sarah?

SNOBS

Honey, I have Homeland Security on the phone.....they would like to know if you have any suspects who egged your Rolls Royce Sarah?.....................Uh yaaah.....three quarters of the state of Alaska!

THey tried and the custody

THey tried and the custody investigator TWICE said that he is a great father and the children love their time with their dad and they should parent the children together. The courts have tried to do their best to do what is right, Molly and her family have been relentless about trying time and time again to get them away from their dad, What kind of a mother wants their children to be brought up without a father.

Ominous Words for Palins

Pride cometh before a fall....

Wasting More of the States Money

Regardless of Halcro's independent swing on things, it is his as well as other bloggers, and talk radio hosts who are responsible for the attacks on Monegan or his reputation. All the misinformation and allegations leveled at the governor have hardly been proven by Branchflowers report. I encourage all Halcro listeners and readers to read the entire report not just the parts Andrew reads to us. Monegan's testimony hardly supports the fact that the "governor" pressured him to fire Wooten. In fact, at the top of page 27 of the Branchflower report, Monegan,"...so as were walking down the stairs, the governor mentioned to me, she says, I'd like to talk to you about Wooten, and I said, ma'am, I need you to keep an arm's length at this -- on this issue. And if you have further complaints on him, I can deal with Todd on it. And she goes, that's a better idea." (February 2007) Branchflower: "Did you discuss it with the governor any further --..." Monegan: "No." Callers to Andrew's show also seemed frustrated by the amount of time Todd Palin spent with the Governor or on business with the Govnernor. Andrew fails to point out that former Governor Murkowski, who released a memo July 13, 2007, relied heavily on the First Lady. Murkowski Memo: Subject: First Lady, quote: "In addition to her duties as First Lady..., Mrs. Murkowski serves as a senior advisor to the Governor on many issues concerning the State and its citizens. In this capacity, Mrs. Murkowski participates in business meetings, discussions and conferences..." Hand-written post-script by Governor Murkowski, "As a general rule if Nancy doesn't go I don't go -" Seems this is a habit among many elected officicals, past and present. Andrew, it seems, would rather divide the state with negative "what ifs" instead of having confidence in the people of Alaska to choose the direction we want the state to take. New mission Andrew, cost the State more money by encouraging Monegan to sue? It would appear to me that since this entire story originated on your blog you have some culpability as well.

Note: According to testimony in the Branchflower report, State Trooper Gary Wheeler who was on the governor's security detail was asked about Todd's role as first spouse compared to others. Wheeler testified that Nacy Murkowski and Susan Knowles were involved in non-profit activities...Todd Palin was not and spent 50% of his time wandering around the governor's office checking on state business. AH

Think

Seems possible they didn't like people, especially honest people to witness the day to day activities at the palace. All the more reason to dismiss the security detail.

Ohhh Puuuhhhleeeaseee

Only a coward posts anonymously. How fitting for a guy who thinks speaking the truth is what divides a state. (Can anyone say looooser) BUT, to say that anyone besides Sarah Palin herself has any culpability here just shows what a complete pea brain you are.

So, is "beachwriter" your

So, is "beachwriter" your given name? ("only a coward would post anonymously")

Beachwriter is who I am

when I blog. There is much more validty to posts with a moniker than those without. Otherwise your rants are nothing more than a drive by poster with a pea brain.

I disagree, Beachwriter

I post anonymously for fear of retaliation from our vindictive governor.

Good one

funny too.
